July 12, 2012 — Oakland, California – The federal attack on safe access for medical cannabis patients continues. Yesterday morning, taped to the front doors of the nation’s model medical cannabis dispensary, Harborside Health Center in Oakland and San Jose, was an official ‘Complaint for Forfeiture of Property.’ The complaint is signed by U.S. Attorney Melinda Haag, Assistant U.S. Attorney Arvan Perteet, and DEA Agent David White, filed on July 6, 2012, in the District Court San Francisco Division and received by the court on Sunday, July 9. The complaint seeks forfeiture of real estate and improvements on the grounds that cannabis is being distributed on the premises, in violation of federal law.

This latest federal action to seize property flies in the face of promises made by Haag to exclusively target dispensaries less than 1000 feet from a school, and recent statements from U.S. Attorney General Eric Holder, who stated that only those dispensaries out of compliance with state law would be subject to Federal enforcement actions. Harborside Health Center is neither close to a school, nor out of compliance with state law. The location at 1840 Embarcadero is more than 1000 feet from the closest school, and Harborside is widely recognized as the most legally compliant dispensary in the state, and renowned nationwide.

“Harborside has nothing to hide or be ashamed of,” said Steve DeAngelo, Executive Director of Harborside Health Center. “We will contest the DOJ action openly and in public, and through all legal means at our disposal. We look forward to our day in court, and are confident that justice is on our side.”

Harborside Health Center employs over 100 people, and is Oakland’s second largest retail tax payer. Last year, HHC paid combined taxes in excess of $3 million, over a million dollars of which went directly to the City of Oakland. Should Harborside be forced to close:

Our 100,000 patients will return to the illegal marketplace
Street drug sales and law enforcement costs will both rise
Over $3,000,000 in tax revenue will be destroyed
Our more than 100 current employees will become jobless

“This is a policy that hurts not only those who depend on cannabis for medicine. It will destroy tax revenue, endanger patients, increase unemployment, and empower criminals. Whoever thinks this is a good idea must be smoking something a lot more powerful than cannabis,” said DeAngelo.

General Electric Paid No Federal Taxes in 2010

The top tax bracket for U.S. corporations stands at 35 percent, one of the highest rates in the world. So how is it possible that a giant of American business, General Electric, paid nothing in federal taxes last year, even as it made billions in profit?

And should the CEO of GE, Jeffrey Immelt, be advising the president on business?

For two years, President Obama has been talking about the need for corporate tax reform, declaring that the system is too complicated and that companies pay too much.

“Simplify, eliminate loopholes, treat everybody fairly,” Obama said in February.

For those unaccustomed to the loopholes and shelters of the corporate tax code, GE’s success at avoiding taxes is nothing short of extraordinary. The company, led by Immelt, earned $14.2 billion in profits in 2010, but it paid not a penny in taxes because the bulk of those profits, some $9 billion, were offshore. In fact, GE got a $3.2 billion tax benefit.

JPMorgan and GE Got Massive Fed Loans While Their CEOs Sat on NY Fed Board

Slowly, piece by piece, the inside details of what happened during the financial meltdown are coming to light. The latest disclosure is that JPMorgan Chase (JPM) CEO Jamie Dimon and General Electric (GE) CEO Jeffrey Immelt were on the New York Federal Reserve Board in 2008, when their institutions got enormous loans, as reported by the New York Times.

This little story tells you just how the insiders do their wheeling and dealing. On Sept. 15, JPMorgan Chase received a $3 billion loan from the Fed. On 12 occasions in October and November 2008, GE issued short term IOUs. The Fed purchased $16 billion of them.

Concerning these deals, Senator Bernie Sanders of Vermont said: “In my view, it is an obvious conflict of interest for CEO’s of banks and large corporations who serve on the Fed’s board of directors to have received cheap loans from the Fed. . . . While they got a huge amount of government support, small businesses are going bankrupt because they can’t receive affordable credit — workers are losing their homes to foreclosure and consumers are being charged 25% to 30% interest rates on their credit cards by the same banks that were bailed out.”

Allan H. Meltzer, an economist at Carnegie Mellon University, said: “It’s ugly. . . . It has the appearance of impropriety.”

GE moving X-ray business to China

General Electric Co.’s health care unit, the world’s biggest maker of medical imaging machines, is moving the headquarters of its 115-year-old X-ray business to Beijing.

“A handful” of top managers will move to the Chinese capital and there won’t be any job cuts, said Anne LeGrand, general manager of X-ray for GE Healthcare. The headquarters will move from Wisconsin amid a broader plan to invest about $2 billion across China, including opening six “customer innovation” and development centers.

The division should have “double-digit” growth rates as the country converts from film and analog to digital X-ray technology, LeGrand said.

This video will tell you what the Unemployment Law Project is, what services we provide, and will guide you to additional resources available from the Employment Security Department and others.

The ULP is a small non-profit law firm that provides free legal advice and representation to people seeking Washington State unemployment benefits, with offices in both Seattle and Spokane.

This video will tell you about important steps to take if you are seeking unemployment benefits, tell you about important deadlines and tell you how Unemployment Law Project may be able to do to help you.

If you haven’t applied for unemployment benefits yet, you can contact the Washington Employment Security Department or E.S.D. online, by telephone, or at a WorkSource office.

If you’ve already applied for benefits and the E.S.D. asked you for more information, you should provide it as quickly as possible. Also, keep filing your weekly claim because you can’t receive benefits for weeks in which you do not file a claim.

If you have applied for benefits and given the E.S.D. all the information it asked for, you should get a formal “determination notice” soon. If you’ve already received a “determination notice” denying you unemployment benefits, Your appeal must be postmarked within 30 days of the date the ESD issued its decision. Read the decision carefully and it will give the exact date by which you need to appeal.

If you’re not sure how to file your appeal, check out the “how-to” videos about that on the Washington Employment Security Department’s website, http://www.esd.wa.gov.

Also, look for more information about the appeal process on http://www.UnemploymentLawProject.org.

If you filed an appeal, or you were receiving benefits and your employer appealed, you will receive a Notice of Appeal Filed letter.

This letter means that a hearing will be scheduled where an administrative law judge will determine whether or not you are eligible for benefits.

That is usually when the U.L.P. gets involved. The ULP concentrates its efforts on helping you prepare for these hearings. Sometimes we are able to represent you at these hearings.

If you want our help, the first step is to call the judge’s office at the Office of Administrative Hearings. You can find the number for the OAH on the Notice of Appeal Filed letter.

Ask to have your file sent to the Unemployment Law Project. If they give you specific instructions about how to do this, be sure to follow them. Wait a day or two, and then call us to see whether we received your file. Be patient. We get hundreds of calls each week and most of the time you will have to leave a voice message, but we will call you back.

If you’re watching this video and you already have a hearing date, you should call the hearing office, and have your file sent to us, then follow up with us quickly to see if we have received it.

If your hearing is within the next few days, we will probably not be able to assist you on such short notice. However, you may request a postponement of the hearing and contact us after that. You may request a postponement by calling the OAH. They can either deny or approve your request for a postponement. If you do not receive written verification that your hearing has been postponed, call in for the hearing as instructed on your Notice of Hearing.

Once you contact us and we have your file, we will set you up with an intake interview over the phone to learn about your case. After that, our staff attorneys will decide what further services we can provide. Those services may include: legal representation at your hearing, or legal advice from one of our attorneys on how to prepare for your hearing and to represent yourself

After your hearing, the judge will issue a decision. This is called an Initial Order. You or your employer might disagree with the judge’s decision. If so, you or your employer must file a written appeal within 30 days. Our services at this stage are limited to advice on how to write the appeal.
